Terms of Use
The ground rules for using CigarShare.
The short version
Welcome to CigarShare. These terms are the agreement between you and us whenever you use cigarshare.com or the CigarShare app. By using CigarShare you agree to them, so please read them. We’ve tried to keep them readable.
- You must be 21 or older.
- What you post is yours. You let us show it on CigarShare.
- Be decent to your fellow members, and don’t game the ratings.
- CigarShare is free and provided as it is. We do our best, but we can’t promise perfection.
- How we handle your information is covered in our Privacy Policy.
Who can use CigarShare
You must be at least 21 years old, and old enough to buy and use tobacco where you live, whichever is higher. By using CigarShare you confirm that you are. If we learn that an account belongs to someone underage, we’ll close it.
Your account
- One person, one account. Give us a real email address you can receive mail at.
- Keep your password to yourself. You’re responsible for what happens under your account, so tell us right away if you think someone else has got into it.
- Your username is public. Don’t pick one that impersonates someone else, infringes a trademark or would embarrass your grandmother.
You can also start and rate a session as a guest without an account. These terms apply to guests too.
Your content
Your sessions, ratings, notes, photos, lists and profile are your content, and you keep ownership of them.
When you post something, you give CigarShare a worldwide, non-exclusive, royalty-free license to store, display, reproduce and adapt it, for example by resizing a photo or making a share card, and to distribute it as part of running and promoting CigarShare. That license ends when you delete the content or your account. It doesn’t cover copies other people have already shared, or anything we have to keep by law.
Only post what you have the right to post. Your own photos are fine. Someone else’s photo of a cigar band or a lounge usually isn’t.
House rules
Think of CigarShare as a good lounge: everyone’s welcome as long as they mind their manners. Please don’t:
- harass, threaten or abuse anyone, or post hateful, sexually explicit or illegal material;
- impersonate another person, brand or shop;
- post fake sessions or ratings, or rate a product you make, sell or are paid to promote without saying so;
- use CigarShare to buy, sell or trade tobacco. It’s a place to log and talk about cigars, not a marketplace;
- send spam, or advertise without our permission;
- scrape, crawl or bulk-download the site, or use bots or automated accounts;
- probe, overload or work around the security of CigarShare or anyone’s account.
We may remove content that breaks these rules, and we decide what does.
Ratings and the catalog
Ratings and notes on CigarShare are members’ opinions and our calculations from them. They aren’t endorsements, and no brand pays for its scores.
We work hard on the cigar catalog, but brand, line and vitola details can be incomplete or out of date. If you spot an error, please tell us. Brand names and logos belong to their owners and are used only to identify their cigars. Their appearance here doesn’t mean a brand is affiliated with CigarShare or endorses it.
Smoke responsibly
Cigars contain nicotine and are not a safe alternative to cigarettes. Nothing on CigarShare is medical advice or encouragement to smoke. Follow the tobacco and smoking laws where you are, and if you’re pairing with a drink, please don’t drive.
Our side of the deal
CigarShare is free to use. We’re always improving it, which means we may add, change or retire features. If we ever retire CigarShare altogether, we’ll give you reasonable notice and a chance to ask for a copy of your data.
The CigarShare name, logo, design and software are ours. You’re welcome to use the app, but please don’t copy or reuse them without our permission.
Suspending or closing accounts
You can stop using CigarShare at any time. To close your account and delete your data, email info@cigarshare.com from the address on your account.
We may suspend or close an account, or block access from a network, that breaks these terms, puts other members at risk, or exposes CigarShare to legal trouble. Where it’s reasonable, we’ll tell you why. If you think we got it wrong, email us.
Disclaimers and liability
CigarShare is provided “as is” and “as available”. As far as the law allows, we make no warranties, express or implied, that it will be uninterrupted, error-free or fit for any particular purpose. That includes the offline features: a session that never reached our servers can be lost with your device.
As far as the law allows, CigarShare is not liable for any indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about CigarShare is limited to US $50.
If your misuse of CigarShare, or content you post, leads to a claim against us, you agree to cover the reasonable costs that result.
Some places don’t allow some of these limits. Where that’s the case, they apply only as far as your local law permits, and nothing here takes away rights you have as a consumer that can’t be waived.
Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Any dispute that we can’t settle informally by talking it over first goes to the state or federal courts in Oregon, unless the law where you live gives you the right to bring it at home. If any part of these terms turns out to be unenforceable, the rest still stands.
Changes to these terms
We may update these terms as CigarShare changes. When we do, we’ll update the date at the top, and if the change is significant we’ll tell you in the app or by email before it takes effect. If you keep using CigarShare after that, you accept the new terms.
